Information Collected:

Boats.com is the sole owner of the information collected on this site. Boats.com collects information at several different points on this web site as discussed below:

Registration: To view certain areas (e.g. MyBoats.com) of the Boats.com site, and to use certain services (e.g. MyBoats Alert) provided by Boats.com, a user must first register by completing the registration form. During registration a user is required to provide their e-mail address. It is used to inform the user of the services on the Boats.com site for which the user expressed an interest. Location information (post code and country) can be entered in the Personal Settings so that we can present region specific advertising and currency. The provision of the personal information (such as name and address) requested by the Personal Settings form is optional.

Newsletters: Site visitors can sign up for newsletters from Boats.com. In order to receive a newsletter, an e-mail address must be submitted to Boats.com. You can also e-mail us at ecs@boats.com.

Special Offers: We send all new registered site visitors a welcome e-mail to verify that the account has been set up. Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users, we present the option to not receive these types of communications.

Personal Boat Shopper: To keep site visitors informed with respect to new boat listings on the web site, we offer the MyBoats Alert feature which is an e-mailing list service. In order to provide this e-mailing list service, we collect e-mail addresses from site visitors who want to participate in the MyBoats Alert. The provision of information in the form of e-mail is not optional if a site visitor chooses to participate in the e-mailing list service. To remove your name from any e-mail offer list, click the unsubscribe link in any of our marketing e-mails or contact our Customer Service Centre.

Surveys and Contests: To improve services and the quality of the web site as well as our site visitors' experience on the web site, we conduct surveys and contests among site visitors that request the provision of personal information such as name and e-mail address as well as non-personal information regarding the site visitor's experience on the web site. Participation in the surveys and contests and the corresponding submission of personal information is optional.

Job Applications: To apply for a job with us, site visitors may send a Curriculum Vitae for our consideration. We collect information provided in the Curriculum Vitae.

E-mails to a Member: Site visitors may communicate directly with a member via a Boats.com contact form. The site visitor who chooses to provide information to the member does so at their discretion. We may keep a copy of these communications. We have no control over what is done with the information collected by the member.

Marine Directory: Site visitors may desire information from companies who have listings in the Boats.com Marine Directory. We may keep a copy of these communications. We have no control over what is done with the information collected by the company with a listing in the Marine Directory, as volunteered by the site visitor.

Web logs: We collect non-personal information such as an IP address, the web address of the page viewed, the referring page address, and the browser information of site visitors in order to count page views on our site for traffic information purposes.

Cookies: We use cookies, which are small text files that are stored on the site visitors computer, to gather and keep track of information related to site visitors, to recognise site visitors when they visit our web site, to personalise their experience and generally to serve site visitors better. For example, a site visitor's address or post code information, entered through one of our forms, can tell us what region-specific advertising the site visitor should see on our site. Cookies also help us review site traffic patterns and improve the site.

Web Beacons: We set a web beacon (a single-pixel invisible image) on web pages and some of our HTML-formatted e-mails. We may use web beacons for a number of purposes, such as to count visitors to our web pages, to monitor how our site visitors navigate our site, or to count how many of the newsletters or e-mails that we sent were actually opened. Additionally, third parties that serve ads or content on this web site, or within our e-mails, may use web beacons. We do not have control over web beacons used by these third parties.

E-mail to Boats.com Staff: When site visitors send an e-mail to a department or staff person, the e-mail may or may not be saved for future reference, and may or may not be forwarded to third parties.

Disclosure of Personal Information Collected:

In order to use this site you do not need to provide any personal information, but where you do volunteer to provide personal information, we may disclose the following information to affiliated third parties such as other web sites owned and operated by Boats.com and to non-affiliated third parties such as marketing companies, vessel brokers, vessel dealers and builders. The disclosed information may include data entered through one of our forms, through cookies, web beacons and web logs such as a site visitor's name, address, e-mail address, other contact information, boat information, boat category, engine information, boat accessories and options, and information about the site visitor's transactions and experiences with companies related to Boats.com.

We use non-personal information such as aggregate demographic data and information about our boats to analyse and develop our marketing strategy and to determine how site visitors found out about us; our site visitors' interests regarding our services; and how to further improve the web site based upon these data.

Examples of these functions include, without limitation, sending e-mails or other communications on our behalf, or providing promotional or marketing assistance. Correcting/Updating Personal Information: If a site visitor's personal information changes, or if a user no longer desires our service, we have provided a way to correct, update or remove that user's personal data provided to us. If the site visitor has registered to view certain areas or use certain services, the site visitor can edit or update their information at the "Personal Settings" page on the site. In order to remove personal data from our site (i.e. cancel your account), you must contact a customer service representative at ecs@boats.com. Any request to update your personal information may take up to 30 days to effectuate.

Links to Other Web Sites: The web site contains links to other sites that are not affiliated with us. Please be aware that we are not responsible for the privacy practices of other sites that we link to. These other web sites operate independently from Boats.com and will have their own privacy and security policies. We strongly encourage site visitors to be alert when they leave the web site and to review the privacy statements of each and every web site that they visit before disclosing personal information.

When site visitors choose to use services requiring sensitive information (such as a credit card number), that information is encrypted and is protected with the best encryption software in the industry - SSL. While on a secure page such as our order form, the lock icon on the bottom of web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked.

While we use SSL encryption to protect sensitive information online, we also do everything reasonable in our power to protect user-information offline. All of our user-information, not just the sensitive information mentioned above, is restricted to authorised users. Only employees who need the information to perform a specific task (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information. Finally, the servers that we store personally identifiable information on are kept in a secure environment.

Children's Use of Web site: Our web site is not directed or targeted to children under the age 13 and we do not knowingly acknowledge or accept orders, registrations or requests for any goods or services from persons under the age of 13. We do not permit anyone under the age of 13 to register with us. If it comes to our attention that a request has come from a person under the age of 13, we will not respond to such a request. Instead we will use reasonable efforts to delete any information provided by that child.

Notification of Changes: It is the site visitor's responsibility to follow our privacy link so site visitors are always aware of our current practices. There will always be a link to our privacy statement on our home page so that site visitors are always aware of our current information collection, maintenance and disclosure practices. Each update is noted with the last updated date. If our privacy practices change in a way that would allow us to use non-public personal information in a manner not previously allowed by the terms of our privacy statement, site visitors will have an opportunity to choose whether to let us use their non-public personal information in the newly proposed manner.
